Terms of Service for Sailing Xperience

Welcome to Sailing Xperience. These Terms of Service ("Terms") govern your access to and use of our website at https://sailingxperience.com ("Site") and all sailing services provided by SC Sailing Experience SRL ("we", "us", "our"), registered in Romania. By accessing or using our Site or booking any of our services, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy.
1. Use of Our Site
The Site provides information about our sailing services and allows for the purchase of these services. The Site is intended for users who are at least 18 years old. By using the Site, you represent and warrant that you meet this age requirement.
2. Accounts and Registration
To access some features of the Site, you may be required to register for an account. You must provide accurate information and promptly update it if it changes. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
3. Services We Provide
Sailing Xperience offers the following categories of services:
Sailing Adventures — themed week-long sailing trips in various destinations
Sailing Training — instructional courses including monohull, catamaran, RYA Day Skipper, and ICC C-D-S certification
Flotillas & Festivals — group sailing events with navigational support and social programming
Yacht Charter — boat rental brokerage with access to third-party vessel inventories
Private Sailing — fully crewed private catamaran experiences
The specific terms, pricing, dates, and inclusions for each service are described on the relevant pages of the Site and in any booking confirmation you receive. In case of conflict, your booking confirmation takes precedence over general website descriptions.
4. Bookings and Payments
4.1 How a Booking Is Confirmed
A booking is confirmed once we receive your deposit payment and send you a written confirmation by email. Until confirmation is sent, no contract exists between you and Sailing Xperience.
4.2 Deposits and Payment Schedule
Most services require a deposit to reserve your spot. The deposit amount and remaining payment schedule are stated on each service page and in your booking confirmation. Failure to pay the remaining balance by the stated deadline may result in cancellation of your booking.
4.3 Guest Selection
For certain experiences, we reserve the right to select participants based on sailing experience, group composition, or other criteria relevant to safety and the quality of the experience. If your application is not accepted, any payments made will be refunded in full.
4.4 Transferring a Booking
If you are unable to attend, you may request to transfer your booking to another person, subject to our approval. Transfer requests must be made in writing to anchor@sailingxperience.com at least 14 days before the departure date. We may decline a transfer if the replacement participant does not meet the requirements of the experience.
4.5 Payment Processing
We use third-party services for payment processing. By submitting your payment information, you authorize us to share it with these processors solely for the purpose of completing your transaction. We do not store your full payment card details.
5. Cancellations and Refunds
Our cancellation and refund terms are described in detail in our Refund Policy. By booking with us, you agree to the terms set out in that policy.
6. Participant Responsibilities and Safety
6.1 Physical Fitness
Sailing involves physical activity and exposure to weather, sea conditions, and confined living spaces. By booking, you confirm that you are in adequate physical and mental health to participate. You must disclose any medical conditions, allergies, or disabilities that may affect your safety or the safety of others at the time of booking.
6.2 Skipper's Authority
The skipper has absolute authority over all decisions relating to the safety of the vessel, crew, and passengers. This includes but is not limited to changes in itinerary, route, anchorage, departure times, and the decision to remain in port. Participants must comply with the skipper's instructions at all times.
6.3 Behavior On Board
Participants are expected to behave responsibly and respectfully toward fellow guests, crew, and the vessel. We reserve the right to remove any participant whose behavior is dangerous, disruptive, or in violation of the skipper's instructions — without refund.
6.4 Alcohol and Substances
Moderate consumption of alcohol is part of some of our experiences (e.g., Whisky Sailing, Guinness Sailing). However, excessive intoxication or use of illegal substances that compromises safety on board is grounds for removal from the trip without refund.
7. Assumption of Risk
Sailing is an activity that carries inherent risks, including but not limited to adverse weather, rough seas, equipment failure, seasickness, injury, and — in extreme circumstances — risk to life. By booking and participating in any Sailing Xperience service, you acknowledge and voluntarily accept these risks.
We take all reasonable precautions to ensure your safety, including the use of qualified skippers, maintained vessels, and safety equipment. However, participation is at your own risk to the extent permitted by law.
8. Travel Insurance
We strongly recommend that all participants purchase comprehensive travel insurance that covers trip cancellation, medical expenses, emergency evacuation, and personal liability for the duration of the experience. For certain experiences, proof of travel insurance may be required before departure.
Sailing Xperience is not an insurance provider and is not liable for costs arising from medical emergencies, trip interruptions, or travel disruptions that would have been covered by adequate insurance.
9. Itinerary Changes and Force Majeure
9.1 Itinerary Changes
All itineraries are indicative and subject to change based on weather, sea conditions, port availability, and the skipper's judgment. We will make reasonable efforts to deliver the planned itinerary, but no specific route, anchorage, or stop is guaranteed.
9.2 Force Majeure
We are not liable for failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, pandemics, government restrictions, port closures, strikes, or war. In such cases, we will work with you to reschedule or provide credit toward a future experience. Refund terms under force majeure are described in our Refund Policy.
10. Yacht Charter Brokerage
When you book a yacht through our charter search tool, we act as a broker connecting you with third-party vessel owners and charter companies. The charter contract is between you and the vessel owner/charter company. We facilitate the booking and provide support, but the vessel owner's terms and conditions apply to the charter itself. We are not liable for the condition of third-party vessels or the actions of third-party crews.
11. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of SC Sailing Experience SRL or its content suppliers and is protected by international copyright and intellectual property laws. You may not copy, distribute, or reproduce any part of the Site without our written consent.
12. Prohibited Conduct
You agree not to:
Copy, distribute, or disclose any part of the Site in any medium without authorization
Use automated systems, including bots, spiders, or scrapers, to access the Site
Transmit spam, chain letters, or unsolicited communications
Attempt to interfere with the security or integrity of the Site
Impose an unreasonable load on our infrastructure
13. Limitation of Liability
To the maximum extent permitted by applicable law, SC Sailing Experience SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or participation in our services.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Romanian law or EU consumer protection regulations.
For services delivered as described, our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.
14. Dispute Resolution
14.1 Direct Resolution
If you have a complaint, please contact us first at anchor@sailingxperience.com. We will make reasonable efforts to resolve the matter directly.
14.2 Alternative Dispute Resolution
If we cannot resolve your complaint, you may refer the matter to ANPC (Autoritatea Națională pentru Protecția Consumatorilor) or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14.3 Governing Law
These Terms are governed by and construed in accordance with the laws of Romania. Any disputes that cannot be resolved through the mechanisms above shall be submitted to the competent courts in Romania.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated by email where possible. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.
