Terms & Conditions: RYA courses provided by Sailing Xperience in association with RYA recognised Training Centres

Welcome to Sailing Xperience. These Terms and Conditions govern the relationship between our training center and our students. By completing your booking and submitting payment, you signify your full agreement to these terms.

1. Definitions

  • "We", "our", "ourselves", and "us" refers to Sailing Xperience.

  • "You", "your", and "yourself" refers to the person whose name appears on the booking form.

  • “Course” refers to the tuition and associated facilities provided by Sailing Xperience to teach elements of navigation, seamanship, powerboating, and sail cruising.

2. The Contract & Changes

  • Evidence of Contract: A binding contract is formed upon the completion of a booking form or the banking of your remittance by Sailing Xperience.

  • Course Changes: Students are not entitled to change the date or type of a confirmed reservation. However, Sailing Xperience will make every reasonable effort to accommodate changes where practical.

  • Operational Flexibility: We strive to provide courses as published. However, due to weather, mechanical breakdowns, or staff illness, we reserve the right to modify the yacht type, instructor, or schedule. We guarantee a service of equal quality in such instances.

3. Cancellations & Refund Policy

You may cancel your course at any time; however, the following cancellation penalties apply based on the notice provided:

Note: Sailing Xperience reserves the right to cancel a course at any time without penalty. We are not liable for additional costs (e.g., flights) associated with such cancellations.

4. Payment Terms

  • Deposit: A 30% deposit is required to reserve your place.

  • Balance: All courses must be paid in full at least 10 days prior to the start date.

5. Safety, Conduct & Responsibility

  • Limitation of Responsibility: Our responsibility begins when you arrive at our marina base and ends upon your departure. We are not responsible for travel delays (flights/transfers) unless supplied by us. We strongly recommend comprehensive travel insurance.

  • Conduct Aboard: If a student endangers the vessel, property, or others, or behaves in a disorderly manner, Sailing Xperience reserves the right to remove that individual from the vessel.

  • Authority: You agree to abide by the orders of the Skipper/Instructor at all times. The Skipper’s decision is final.

  • Medical/Legal Compliance: You are responsible for complying with all laws and possessing valid travel/health documents for Greece.

6. Health & Safeguarding Policies

  • Safety Statement:Sailing Xperience is committed to maintaining safe and healthy working conditions and equipment.

  • Safeguarding: We maintain a zero-tolerance policy for abusive language, intimidation, or aggressive behavior. All instructors follow the RYA Instructor Code of Conduct.

  • Equal Opportunities: We ensure all participants are treated fairly regardless of age, sex, disability, race, religion, or orientation.

7. Assessment & Disputes

  • Certification: Assessment is continuous. The Instructor’s/Examiner’s decision on passing or failing is final. Redress can be sought via the Royal Yachting Association (RYA).

  • Dispute Resolution: Initial dissatisfaction should be raised with the Instructor, then the School Principal. Unresolved matters will be referred to the RYA Training Department for adjudication.

8. Privacy & Data Protection

We collect your data to manage your booking, ensure safety (medical/dietary), and register certificates with the RYA.

  • Data Retention: Personal info is destroyed within 3 months of course completion, except for certification records held for 3 years.

  • RYA Sharing: Successful completion of Powerboat, Day Skipper, or Coastal Skipper courses requires sharing data with the RYA via their secure portal for qualification recording.

  • Online Courses: For RYA Interactive courses, your data is shared with the RYA and "Learning Pool" to enable platform access.

9. Jurisdiction

Any disputes arising from our courses shall be subject to the non-exclusive jurisdiction of the Courts of Romania
